Proposed Builder’s Guide Amendment: Street Tree Maintenance — Board Vote September 28

The Association is proposing an amendment to the Har-Ber Meadows Builder’s Guide regarding the maintenance and replacement of street trees.

The purpose of this amendment is to clarify and explicitly state a responsibility that is already written in the existing Builder’s Guide, rather than to create a new requirement for property owners.

What the Builder’s Guide already says

Section 2.4.2 recognizes that street trees are an important part of the overall design of Har-Ber Meadows. Street trees contribute to the consistent and recognizable character of the community, enhance the appearance of the streets and entryways, promote continuity and walkability, and reinforce the overall identity of the neighborhood.

Section 2.4.3 establishes the street-tree requirements, including the required size, location, and the responsibility of the builder to provide street trees on designated streets. It also provides that builders are responsible for supplying street trees on other streets, including side streets adjacent to lots that may front on those streets.

Section 8.2 further provides that the builder/owner is responsible for individual site development and maintenance, including the area within the public street right-of-way between the back of the street curb and the property line. The builder/owner of a corner lot is responsible for the right-of-way for both streets.

The proposed change

The proposed amendment to Section 8.2 is intended to make clear that this existing maintenance responsibility includes the ongoing maintenance and replacement of street trees located within the applicable right-of-way. Specifically, the proposed addition would state:

“Street trees are an important part of preserving the intended design, walkability, and overall character of the Har-Ber Meadows community. Property owners are responsible for maintaining and replacing street trees when necessary, including trees lost or damaged due to storms, age, disease, accidents, or any other cause.”

The intent of this amendment is not to add a new obligation or change the overall intent of the Builder’s Guide. Rather, it is intended to remove any ambiguity by expressly stating what is already implied by the existing provisions concerning street trees and the owner’s responsibility for maintenance of the street right-of-way.

Board consideration

The Board of Directors will consider and vote on the proposed amendment at its next Board meeting, which will be held on September 28, 2026, at 6:00 p.m.

Property owners are encouraged to review the proposed amendment prior to the meeting. Owners who have questions or comments regarding the proposed amendment are welcome to share them with the Association before the Board meeting.
